Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Erudiway (“we,” “us,” “our”) at erudiway.com and its associated applications (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years of age to use the Service. By using the Service, you represent that you are 13 or older. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Account Registration
- You must provide accurate, current, and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
- You must notify us immediately at support@erudiway.com if you suspect unauthorized use of your account.
- You may not share your account or transfer it to another person.
3. Subscriptions and Billing
Free tier
Certain features of the Service — including a limited number of practice questions per topic — are available at no cost without an account. Free access may be changed or limited at our discretion.
Paid subscriptions
- Paid subscriptions are billed in advance on a recurring basis (monthly or per-semester) via Stripe, Inc.
- Prices are stated in USD and are subject to change with 30 days’ notice.
- You authorize Erudiway to charge your payment method on each billing cycle until you cancel.
Cancellation
- You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you retain access until then.
- We do not offer partial-period refunds for cancellations made mid-cycle.
Refunds
We offer a full refund within 7 days of your initial subscription purchase if you have completed fewer than 50 practice questions. To request a refund, email support@erudiway.com with your account email and order details. After 7 days or 50 questions (whichever comes first), all sales are final.
4. Acceptable Use
You agree not to:
- Copy, reproduce, distribute, or resell any questions, notes, or content from the Service for commercial purposes
- Share your login credentials or allow others to access the Service using your account
- Use automated tools (bots, scrapers) to extract content from the Service
- Submit false, misleading, or harmful content
- Attempt to reverse-engineer, disrupt, or gain unauthorized access to the Service or its infrastructure
- Use the Service in any way that violates applicable laws or regulations
We reserve the right to suspend or terminate accounts that violate these rules without refund.
5. Intellectual Property
All content on the Service — including practice questions, study notes, explanations, and design — is owned by or licensed to Erudiway and protected by copyright and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial educational purposes. This license does not include any right to resell, reproduce, or distribute content.
You retain ownership of any content you submit to us (e.g., support messages). By submitting content, you grant us a non-exclusive license to use it to operate and improve the Service.
6. Disclaimers
The Service is provided for educational and exam preparation purposes only. Erudiway is not affiliated with ATI Testing, HESI/Elsevier, the National Council of State Boards of Nursing (NCSBN), or any other exam body. NCLEX® is a registered trademark of the NCSBN. ATI® and TEAS® are registered trademarks of Assessment Technologies Institute, LLC. HESI® is a registered trademark of Elsevier.
We make no guarantee that use of the Service will result in passing any particular exam. Individual results depend on many factors outside our control.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ERUDIWAY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, DATA LOSS, OR EXAM FAILURE — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ERUDIWAY IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $50 USD.
8. Governing Law and Disputes
These Terms are governed by the laws of the United States. Any dispute arising from these Terms or your use of the Service shall first be addressed through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in English. You waive any right to bring claims as a class action.
9. Modifications to the Service and Terms
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice. We may also update these Terms. Material changes will be communicated via email or a notice on the Service. Continued use after changes constitutes acceptance of the revised Terms.
10. Termination
You may close your account at any time from your account settings. We may suspend or terminate your access if you breach these Terms, with or without prior notice. Upon termination, your license to use the Service ends immediately. Sections 5, 6, 7, and 8 survive termination.
